1. Who we are

Sportly (the sportly.ro website and the Sportly apps for iPhone and Android) is operated by Qbits Technologies SRL, VAT ID 48357432, registered in Timișoara, Romania. You can write to us any time at [email protected].

2. What Sportly does and what it does not

Sportly helps you:

• see open matches in your city and join them;
• organise your own matches and invite players;
• stay in touch with your team through groups, polls and chat;
• follow what is happening in your sport locally.

That is it. Sportly does not organise matches, does not rent courts, does not sell equipment and does not take money for games. Matches are made by players, between themselves. We keep the app running.

3. Your account

You need an account to use Sportly. You create it with your phone number or your email address, and on mobile you can also sign in with Apple or Google.

• We do not use passwords. Every time, you get a one-time code by SMS or email.
• That code is yours alone. Whoever has it can get into your account.
• One account per person. No fake identities, and no accounts created in someone else’s name.
• You need to be at least 16 years old to create an account.
• Your profile details must be real: your name, date of birth, city and sports. People decide whether to play with you based on them.

Your name, photo, age, city, sports and reputation score are visible to other players. We never show your date of birth, only your age. How much each person sees depends on the visibility setting you choose in your profile. Your phone number is visible only to the other players in the matches you join.

4. Matches

Matches on Sportly are created by players, not by us. Whoever creates a match picks the sport, the time, the place and how many people can join, and they are responsible for what happens there.

• To create or join a match you need a complete profile and a verified phone number.
• The organiser can require approval to join the match and can turn a request down without giving a reason. A request the organiser does not answer is settled automatically after one hour.
• When you join a match, the others are counting on you. Not showing up is forbidden; the details are in section 6.
• The cost of the court or the equipment is split between you, directly. Sportly stays out of that and takes no commission.
• We do not inspect venues, we do not guarantee a match will actually happen, and we are not responsible if the organiser cancels it.

5. Respect and fair play

Sportly only works if players can count on each other and enjoy playing together. When you join a match, a group or a conversation, you agree to:

• treat other players with respect, on the court and in the app, whatever their level, age, gender or background;
• arrive on time, play fair and accept the result;
• not insult, threaten or humiliate anyone, in chats or in direct messages;
• follow the rules set by the organiser and the decisions of group or match admins;
• not send friend requests, invitations or messages in bulk to people who did not ask for them;
• mark attendance and answer questions about other players honestly, never out of anger or to get back at someone.

If someone breaks these rules, you can block and report them right from the app. We look at every report.

6. Showing up and reputation

No-shows are forbidden. If you signed up for a match, you show up. A spot taken and left empty ruins the match for everyone else, who planned around you.

• If you can no longer make it, leave the match as early as you can, so someone else can take the spot.
• Leaving a match less than 12 hours before it starts, or cancelling a match in its last 12 hours when other players have already joined, lowers your reputation score.
• After the match, the organiser and the match admins mark who did not show up. Anyone not marked counts as present.
• Every player has a reputation score from 0 to 100 and a level, both visible to other players. The score comes from matches played, no-shows, late withdrawals and cancellations, and anonymous answers from the people you played with.
• A score below 50 limits what you can do: you can only create private matches and groups, and you can join public matches only with the organiser’s approval.
• Repeated no-shows can lead to a temporary or permanent suspension of your access to the app, even if you broke no other rule.
• Marking someone as absent when they were there, or using the anonymous answers to get back at someone, is forbidden and can also lead to suspension.

If you were wrongly marked as absent, write to us at [email protected]. We check it and, if needed, remove the mark and restore your score.

7. Groups, messages and chat

A group can be private, which you only join if someone in it adds you or you accept an invitation, or public, visible to players in your city. What gets written in the group chat stays between members.

A group’s creator can appoint admins. The creator, the admins and a match organiser can remove someone from a group or a match, and a removed player cannot rejoin until they allow it. Admins can keep a note about the reason, visible only to them. Use these powers fairly, never to punish someone unjustly.

You can message any player you share a match or a group with. Anyone else first gets a conversation request, and until they accept it you can send them only one message. Do not use direct messages for ads, pestering or harassment.

Private messages do not go through the content filter and we do not read them for moderation. They are stored on our servers so you can read them on any device, and we can only access them if the law requires it or if we are investigating abuse that was reported to us.

8. Communities and what you post there

Communities are open to players in the same locality. What you post there, text and photos, stays yours. By posting, you give us the right to display that content in the app and on the website for as long as it is published.

Not allowed:

• illegal, violent, obscene or discriminatory content;
• harassment, threats or personal attacks;
• spam, unsolicited advertising or misleading links;
• photos or information about other people without their consent;
• content that is not yours and that you have no right to publish.

Any post or member can be reported straight from the app. We review reports and remove what breaks the rules. We can hide content, limit access to communities, or suspend accounts that keep doing it.

You can post anonymously in communities. Anonymity hides you from other players, not from us: we know who wrote it, and you remain responsible for what you publish.

You can block the author of a post, including an anonymous one. After that you will not see their posts anywhere in the app.

9. Stay on Sportly

Sportly exists so players can find each other, organise and talk in one place. Communities and public groups are visible to every player in your city, so they are not a place to gather members for other platforms.

You must not:

• look for players for a match or a group and send them to reply on WhatsApp, Telegram, Facebook, Discord or another platform, instead of creating the match on Sportly;
• approach players who are looking for a match on Sportly to move them to your group on another platform;
• put invitation links or phone numbers for groups on other platforms in communities, in the name or description of a public group, or in the description of a match;
• repeat the same invitation across several communities or public groups;
• advertise other apps or platforms for organising matches and player groups.

You may still give a phone number or a link to someone who asks for it, tell your friends on WhatsApp about a match created here, and keep your own group of friends on any app. You may not use Sportly as a source of members for your group on another platform.

We remove posts that break this rule, and anyone who keeps doing it can lose access to communities or be suspended. If you see such a post, you can report it directly in the app.

10. What we commit to

• Keeping the app running and fixing what breaks, as fast as we can.
• Protecting your data under GDPR. The details are in the Privacy Policy.
• Telling you in advance when we change something important.
• If you have a verified email address, we send you the public matches in your city every few days. You can turn this off at any time in settings or from the link in the email.
• Answering messages sent to [email protected].

11. What we are not responsible for

Sportly is where you find each other. What happens next happens between you. We are not responsible for:

• injuries or damage during a match;
• matches that get cancelled, postponed, or that nobody shows up to;
• the state of courts, changing rooms or equipment;
• money arrangements between players;
• what other users write or publish;
• outages caused by our providers, by network problems or by cyber attacks.

Sport carries risk. You play at your own risk, and having valid health insurance is a good idea.

Sportly is free for players, so you have paid us nothing. To the extent the law allows, our liability towards you is limited to what you paid Sportly, which is zero.

12. What it costs

Sportly is free for players. We do not ask for your card, there is no subscription, and we take no cut of what you pay at the venue. If paid features ever appear, they will be clearly marked and entirely your choice.

13. What belongs to us

The Sportly name, logo, design, texts and app code are ours. You may not copy, reproduce or reuse them in another product without our written consent. What you publish stays yours.

14. Suspending and deleting accounts

You can delete your account at any time from the app, under Profile, Account, Delete account. You do not need our permission and you do not need to write to us. Exactly what happens to your data at that moment is described in the Privacy Policy.

We can suspend or delete an account if it:

• repeatedly breaks these rules;
• harasses or endangers other players;
• belongs to a player who repeatedly does not show up for matches they signed up for;
• uses attendance marking, anonymous answers or admin powers to harm other players;
• is used for spam, fraud or other illegal activity;
• is fake, or a second account belonging to the same person.

Where possible, we tell you first and give you a chance to explain. Where someone’s safety is at stake, we act immediately.

15. Changes

The app changes, so this text will change too. When we alter something important, we will tell you by email or with a message in the app at least 15 days beforehand. If you disagree with the new version, you can delete your account.

16. Applicable law and disputes

Romanian law applies. If we disagree about something, let us try to sort it out by talking first, at [email protected]. If that fails, the competent courts are those in Timișoara.
