1. Who we are

Sportly (the sportly.ro website and the Sportly apps for iPhone and Android) is operated by Qbits Technologies SRL, VAT ID 48357432, registered in Timișoara, Romania. You can write to us any time at [email protected].

2. What Sportly does and what it does not

Sportly helps you:

• see open matches in your city and join them;
• organise your own matches and invite players;
• stay in touch with your team through groups, polls and chat;
• follow what is happening in your sport locally.

That is it. Sportly does not organise matches, does not rent courts, does not sell equipment and does not take money for games. Matches are made by players, between themselves. We keep the app running.

3. Your account

You need an account to use Sportly. You create it with your phone number or your email address, and on mobile you can also sign in with Apple or Google.

• We do not use passwords. Every time, you get a one-time code by SMS or email.
• That code is yours alone. Whoever has it can get into your account.
• One account per person. No fake identities, and no accounts created in someone else’s name.
• You need to be at least 16 years old to create an account.
• Your profile details should be real. People decide whether to play with you based on them.

Your name, photo, city and sports are visible to other players. How much each person sees depends on the visibility setting you choose in your profile.

4. Matches

Matches on Sportly are created by players, not by us. Whoever creates a match picks the sport, the time, the place and how many people can join, and they are responsible for what happens there.

• When you join a match, the others are counting on you. If you can no longer make it, leave the match early so someone else can take the spot.
• The cost of the court or the equipment is split between you, directly. Sportly stays out of that and takes no commission.
• We do not inspect venues, we do not guarantee a match will actually happen, and we are not responsible if the organiser cancels it.

5. Groups, polls and chat

Groups are private. You only join a group if someone in it adds you or if you accept an invitation. What gets written there stays between members.

Private messages do not go through the content filter and we do not read them for moderation. They are stored on our servers so you can read them on any device, and we can only access them if the law requires it or if we are investigating abuse that was reported to us.

6. Communities and what you post there

Communities are open to players in the same locality. What you post there, text and photos, stays yours. By posting, you give us the right to display that content in the app and on the website for as long as it is published.

Not allowed:

• illegal, violent, obscene or discriminatory content;
• harassment, threats or personal attacks;
• spam, unsolicited advertising or misleading links;
• photos or information about other people without their consent;
• content that is not yours and that you have no right to publish.

Any post or member can be reported straight from the app. We review reports and remove what breaks the rules. We can hide content, limit access to communities, or suspend accounts that keep doing it.

You can post anonymously in communities. Anonymity hides you from other players, not from us: we know who wrote it, and you remain responsible for what you publish.

You can block the author of a post, including an anonymous one. After that you will not see their posts anywhere in the app.

7. What we commit to

• Keeping the app running and fixing what breaks, as fast as we can.
• Protecting your data under GDPR. The details are in the Privacy Policy.
• Telling you in advance when we change something important.
• Answering messages sent to [email protected].

8. What we are not responsible for

Sportly is where you find each other. What happens next happens between you. We are not responsible for:

• injuries or damage during a match;
• matches that get cancelled, postponed, or that nobody shows up to;
• the state of courts, changing rooms or equipment;
• money arrangements between players;
• what other users write or publish;
• outages caused by our providers, by network problems or by cyber attacks.

Sport carries risk. You play at your own risk, and having valid health insurance is a good idea.

Sportly is free for players, so you have paid us nothing. To the extent the law allows, our liability towards you is limited to what you paid Sportly, which is zero.

9. What it costs

Sportly is free for players. We do not ask for your card, there is no subscription, and we take no cut of what you pay at the venue. If paid features ever appear, they will be clearly marked and entirely your choice.

10. What belongs to us

The Sportly name, logo, design, texts and app code are ours. You may not copy, reproduce or reuse them in another product without our written consent. What you publish stays yours.

11. Suspending and deleting accounts

You can delete your account at any time from the app, under Profile, Account, Delete account. You do not need our permission and you do not need to write to us. Exactly what happens to your data at that moment is described in the Privacy Policy.

We can suspend or delete an account if it:

• repeatedly breaks these rules;
• harasses or endangers other players;
• is used for spam, fraud or other illegal activity;
• is fake, or a second account belonging to the same person.

Where possible, we tell you first and give you a chance to explain. Where someone’s safety is at stake, we act immediately.

12. Changes

The app changes, so this text will change too. When we alter something important, we will tell you by email or with a message in the app at least 15 days beforehand. If you disagree with the new version, you can delete your account.

13. Applicable law and disputes

Romanian law applies. If we disagree about something, let us try to sort it out by talking first, at [email protected]. If that fails, the competent courts are those in Timișoara.
